Terms of Use

1. Acceptance

These Terms of Use ("Terms") are an agreement between you and Softshala Nepal ("we", "us") covering the Driving License Tayari mobile app and this website (together, "the app"). By installing or using the app you accept these Terms and our Privacy Policy. If you do not agree, please do not use the app.

2. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial preparation for the driving licence exam.

You may not:

• copy, sell, rent, sub-licence or redistribute the app or its content;
• decompile, reverse-engineer or attempt to derive the source code, except where the law expressly permits it;
• remove or obscure any copyright, trademark or ownership notice;
• scrape or bulk-extract the question bank, traffic sign library or any other content, or republish it in another app, website or printed material;
• use the app in any way that breaks the law or infringes anyone's rights.

3. Eligibility & accounts

• The app is intended for people preparing for a driving licence in Nepal and is not directed at children under 13.
• Most of the app works without an account. Signing in with Google or Sign in with Apple is optional and enables cloud backup and leaderboards.
• You are responsible for the security of the Google or Apple account you sign in with, and for everything done through your account.
• Provide accurate information, and tell us promptly at [email protected] if you suspect unauthorised use.
• You may delete your account at any time. See Delete my data.

5. Not a government service

Softshala Nepal is an independent developer. The app is not affiliated with, endorsed by, or operated by the Government of Nepal, the Department of Transport Management, or any traffic authority. Features such as the smart card licence search and "Apply Driving License" simply open the relevant official website inside the app; the information they show, and the handling of anything you submit there, is entirely the responsibility of that government service.

6. Your content

"Your content" means what you add to the app: vehicle details, reminder dates, service and fuel logs, saved licence numbers, and any photos of documents you attach.

• You keep ownership of it. We claim no rights over your content.
• You grant us only the limited permission needed to store, back up, sync and restore it for you, and to display it back to you in the app.
• You confirm you have the right to upload what you upload, and that it does not infringe anyone else's rights.
• Do not upload other people's identity documents without their permission, or anything unlawful.
• While signed out, your content stays on your device only, so if you lose or wipe the device before signing in, it cannot be recovered. Cloud backup is a convenience, not a guaranteed archive; keep your own copies of anything important.

7. Acceptable use

You agree not to:

• interfere with, overload or attempt to gain unauthorised access to the app, our servers or another user's account or data;
• use bots, modified clients, emulators or any other means to falsify scores or ad views;
• upload malware, or content that is unlawful, abusive, obscene, hateful or infringing;
• impersonate another person, or use a display name that is offensive or misleading;
• use the app for any commercial purpose, including training classes or resale, without our written permission.

8. Games & leaderboards

The mini-games are entertainment. They involve no wagering, no prizes and no real-money play. If you are signed in, your display name, profile photo and best scores appear on public in-app leaderboards. Play signed out if you would rather not appear. We may remove scores obtained by cheating or exploiting bugs, and may reset a leaderboard at any time.

Bluetooth multiplayer connects directly to a nearby device. Use it only with people you know, and only where it is safe to do so.

9. Advertising

• The app is free to download and use, and is supported by advertising served through Google AdMob.
• There is nothing to buy. The app contains no in-app purchases and no subscriptions, and we never ask you for payment or card details.
• We do not choose the individual ads you see and are not responsible for advertisers' products, claims or websites. Any dealing you have with an advertiser is between you and them.
• Some ads promote our own apps; tapping one simply opens that app's store page.
• You can limit ad personalisation through your device settings. See the Privacy Policy for how.

10. Intellectual property

The app, its name, logo, design, code, compiled question bank, illustrations and other content are owned by Softshala Nepal or our licensors and are protected by copyright and trademark law. Traffic sign imagery and legal or regulatory text remain the property of their respective owners and are reproduced for educational purposes. Nothing in these Terms transfers ownership to you.

11. Third-party links & services

The app links to and embeds third-party services: Google Firebase and AdMob, Google and Apple sign-in, YouTube videos, the DoTM website, and store pages for our other apps. We do not control them and are not responsible for their content, availability or practices. Your use of those services is governed by their own terms and privacy policies.

12. Availability & updates

We aim to keep the app available but do not promise uninterrupted service. Features may be added, changed or removed, and some features require an internet connection or a minimum app version. We may require you to update to a supported version to keep using the app, and we may discontinue the app entirely on reasonable notice.

13. Suspension & termination

You may stop using the app at any time by deleting your account and uninstalling it. We may suspend or terminate access if you break these Terms, abuse the service, or where required by law. Sections that by their nature should survive termination (intellectual property, disclaimers, liability, governing law) continue to apply.

14. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be error-free or uninterrupted, that content is complete or current, or that any defect will be corrected.

15. Limitation of liability

To the maximum extent permitted by law, Softshala Nepal will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits, goodwill, exam results or opportunity, arising out of your use of, or inability to use, the app, including any failure of a reminder notification to arrive, any loss of backed-up data, and any reliance on the study content.

The app is provided to you free of charge. Where liability cannot lawfully be excluded, our total liability for any claim is limited to NPR 1,000.

Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

16. Indemnity

You agree to indemnify and hold Softshala Nepal harmless from claims, damages and reasonable costs arising from your breach of these Terms, your misuse of the app, or content you upload.

17. Changes to these terms

We may update these Terms as the app develops. The "last updated" date at the top will change, and material changes will be announced in the app or on this page. Continuing to use the app after an update means you accept the revised Terms.

18. Governing law

These Terms are governed by the laws of Nepal, and the courts of Kathmandu have exclusive jurisdiction over any dispute, without affecting any mandatory consumer protection rights you have where you live.

Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the app. Where the app is obtained through the Apple App Store, the Apple Media Services terms also apply, and Apple's subsidiaries are third-party beneficiaries entitled to enforce these Terms against you.
